Indore: Road accidents happen all over the country. But, a road accident in Indore, Madhya Pradesh is being discussed a lot. This is a road accident in which the complainant is the accused. Due to a pothole on the BRTS located on AB Road in Indore, the wife going with her husband on a scooter became a victim of the accident. They had a two-year-old child with them. The wife suffered head and leg injuries, she was taken to the hospital and the police also reached on information.

The wife was not in a position to give a statement. Instead, her husband Ravi Gaud, who was driving the scooter, gave a statement and said that his own negligence was the reason behind the incident. On this basis, the police registered a case against the husband, meaning the husband became the complainant and the accused. The police usually waits for the injured to recover for recording the statement. In this case, a different situation arose. The police registered a case against the husband Ravi Gaud without waiting.

These things are mentioned in the FIR
The husband said in the FIR… ‘On September 14, at around 8 pm, I (Ravi Gaur) was going to see a doctor in Naulakha via Vijay Nagar, with my wife Shanu Gaur and two 2-year-old son sitting in the back seat of my younger brother Kartik Gaur’s Activa MP 09 DH 8539. As soon as I reached the LIG intersection, the security personnel deployed here diverted the traffic from inside the BRTS due to traffic jam. In a hurry, I started driving my car fast and carelessly. Meanwhile, the balance got disturbed as the car went into a pit in the BRTS. My car jumped and my wife sitting behind fell on the road with the child. My wife got injured in the head and the heel of the right leg. Blood started flowing. Lokchand Kushwaha and the people present nearby saw the incident. I took my wife in an auto rickshaw and took her to CHL Care Hospital with the help of passersby, where she was admitted to the ICU.’ However, she has also been discharged.

blamed himself
In road accidents, the Municipal Corporation is often blamed, but here the person has blamed himself, so there is another interesting aspect in the case. The place where the accident happened is a BRTS restricted for normal vehicles. Only city buses, ambulances, fire engines or permitted vehicles are allowed to ply here. The family travelling on a scooter met with an accident here, and it is specifically mentioned in the FIR that they were travelling on this BRTS during a traffic jam on the instructions of the police. Please note that if this is not mentioned and the accident happens in a restricted area, then there can be a problem in the claim.

Importance of eyewitness testimony in the case
• Eyewitness Lokendra Kushwaha confirmed that Ravi was driving fast and recklessly.
• Based on the statement of eyewitness and husband Ravi Gaur, police have registered a case against the Activa driver i.e. the husband under sections 281, 125A.
• Section 281 deals with rash driving which endangers the life of any person and driving in a negligent manner.
• This includes rash driving and careless overtaking, driving under influence of alcohol or drugs. The accused can be jailed for 6 months. If a person gets minor injury, the culprit can be jailed for six months or fined Rs 5,000 or both.

The police are also surprised
MIG Thana TI Manish Lodha said that after the husband’s confession, a case has been registered against the driver i.e. the husband. The matter is under investigation. We will write a letter to PWD and Municipal Corporation to fill the potholes so that such incidents do not happen. This is the first case where the accused and the complainant are the same.
